Thank God --- This happened in USA not in India. http://www.rediff.com/us/2001/aug/18us2.htm http://www.statenews.com/article.phtml?pk=9127 In India section 498A of Indian Penal Code would have complicated the matter denying Justice to real victim. FACTS. 1. Wife told the Court that Husband was abusive and had slapped, pushed and pulled her hair many times. 2. Wife said she and her husband had been in an argument the day of the stabbing and her husband dragged her by the hair around an island counter in their kitchen. 3. Wife said she was scared and in pain so she grabbed the first thing that she came across and swung it at her husband. 4. In closing arguments, wife's attorney, argued she had not committed any crime and stabbed her husband so he wouldn’t hurt her. 5. Wifes Attorney said the couple, who are natives of India, had married out of love, instead of the arranged marriage their families had hoped for, causing WIFE to be ashamed to talk of the abuses. 6. She said she felt she needed to work harder to make their marriage work because of the frustrations they had put their families through. Now the Question is that : Can the parents of the Girl who are residing in India file criminal case under Section 498A of Indian Penal Code for cruelty to their daughter against parents of her deceased husband and get them arrested and Jailed as the Judgements of foreign courts are not acceptable to Indian courts.?
